Client Agreement

This Photography Services Agreement is made and entered into, between Joanne Snell, trading as These Days Photography (referred to as the “Photographer,”) and the “Client” who is the main person corresponding with the Photographer on this project.

  1. Scope of Work

1.1 The Scope of Work includes the following photography services to be provided by the Photographer for the Client, on the date, location and time as agreed per former correspondence:

  • One 5 minute portrait session with each registered child. 

1.2 Deliverables: The Photographer shall deliver a gallery, with roughly 10 edited digital images to choose from. The gallery will be delivered within a period of two weeks from completion of the photo session. Clients have14 days to choose their package and download and save their JPEG images. After this time the gallery will be closed. 

2. Delivery Timeline

2.1 Timeline: The Photographer shall deliver the final edited and photographs to the Client within two weeks following the photography session or project completion.

2.2 Consequences of Delay: In the event of unforeseen circumstances that result in a delay in the delivery of the final photographs, the Photographer shall promptly notify the Client and make reasonable efforts to expedite the delivery. However, the Photographer shall not be held liable for delays due to circumstances beyond their control.

3. Make-up days

Make-up days are done at the discretion of The Photographer and the educational centre. They are not guaranteed as part of this service. 

4. Copyright and Usage Rights

The Photographer retains the copyright to all photographs created during the photography session.

5.Permissions and Model Releases

5.1 The Photographer fully respects your right to privacy and has a strict policy of complying with the terms of the Data Protection Acts 1988 and 2004/5

5.2 Model Releases: Clients are required to complete registration and model release before their child can be photographed. No child will be photographed without a completed registration 

6. Payment and Refund Policy

6.1 All digital orders are final, non-refundable and non-transferable once payment has been made. 

6.2. As the prints provided are personal to you and have no re-sale value we regret that we cannot cancel or provide refunds once your oder has been placed into production. 

7. Image Retouching and Editing

7.1 Editing Style: The Photographer shall edit the photographs according to their professional style and judgment, ensuring the images meet the Photographer’s portfolio standards. Edits is limited to basic colour adjustments and cropping. They do not include re-touching of the skin, or removal of unwanted details, such as bruises, cuts or rashes. 

7.2 Additional work requiring Photoshop will incur additional charges and Clients need to request this no later than one week of gallery delivery.

8. Duty of Clients

8.1 The Client understands that if their child can’t make to agreed photography date, no make-up date is guaranteed 

8.2 The Client understands that the Photographer cannot photograph any child who has not been registered by the agreed date.

8.3 The Client agrees to save their digital images in at least two places (ideally one cloud based system and one external hard drive) and understands that the Photographer does not hold these JPEGs beyond one year. 

8.4 The Client understands that any retouching has to be requested within one week of receiving the gallery. 

9. Image Archiving

The Photographer shall retain copies of the final JPEG photographs for a period of one year following delivery to the Client. RAW files will be held for one month following delivery of JPEGs.

10. Ownership of RAW files

10.1 RAW File Access: The Client will not have access to the unedited RAW image files.

10.2 RAW File Archiving: RAW files kept for a period of one month following the delivery of JPEGs to the Client. 

11. Liability and Indemnification

11.1 Whilst caution is always taken, the Photographer shall not be held liable for any damage to or loss of equipment, loss of images, or personal injury sustained during the photography session.

11.2  The Photographer is not responsible for un-cooperation of a child during the session. No poses or smiles will be forced.

11.3 Indemnification: The Client agrees to indemnify and hold the Photographer harmless from any claims, losses, or liabilities arising from the Client's use of the photographs, including (but not limited to) claims related to copyright, trademarks, online viruses or privacy rights.

11.4 Whilst caution and care is always taken, if the Photographer is unable to deliver products due to technical dysfunctions or other causes beyond the photographers control, all fees shall be returned to the client and These Days Photography shall maintain no further liability.

11.5 JPEGs will only be kept on files for a period of twelves months. Your purchase of the digital files releases the Photographer from any liability beyond this timeframe.
